In issue 7/2025 of Ποινική Δικαιοσύνη (Criminal Justice), p. 717 ff., the presentation of the CJEU judgment of 8 May 2025 (C-530/23) is published, together with a brief commentary.
The judgment addresses the crucial right of timely access to a lawyer and the provision of legal aid in criminal proceedings, with particular emphasis on vulnerable persons. At the same time, it examines whether, and under what conditions, statements obtained without the presence of a lawyer may be excluded from use.
The judgment under commentary confirms the primacy of EU law, strengthens the substantive protection of vulnerable persons, and entrusts national courts with the assessment of the admissibility of statements obtained in violation of the right of access to a lawyer.
By aligning itself with the case law of the ECtHR, the CJEU reinforces the core of the right to a fair trial within the field of criminal law.
